1. Information We Collect

The information we receive depends on how you interact with us and what you choose to provide. Relevant categories include:

·       Contact information: Your name, email address, telephone number, mailing address, and preferred method of contact.

·       Property and project information: Project address, property type, proposed scope, budget, desired timing, selections, site conditions, and related correspondence.

·       Documents and images: Plans, specifications, surveys, photographs, videos, estimates, proposals, approvals, and other materials you submit. These materials may contain personal information about you or others.

·       Business relationship information: Company name, role, authorization to act for a property owner or organization, and information needed to evaluate or coordinate an engagement.

·       Transaction and administrative information: Contract records, invoice and payment status, insurance or permitting documents, and records necessary for project administration. Where a third-party payment provider is used, its handling of payment credentials is subject to its own privacy practices.

·       Technical information: Information that may be generated when the website is accessed, such as IP address, browser and device type, referring page, pages requested, access times, and security or error logs. Collection depends on the website’s hosting configuration and enabled features.

Please provide only information reasonably necessary for your inquiry or engagement. Do not send Social Security numbers, passwords, financial-account credentials, health records, or other sensitive information through ordinary website forms or unsecured email. Contact us before providing sensitive documents so that an appropriate method can be arranged.

2. Sources of Information

We receive information directly from you through inquiries, telephone calls, emails, meetings, document uploads, and project communications. We may also receive relevant information from an authorized property owner, representative, architect, engineer, subcontractor, supplier, referral source, or other project participant.

Website infrastructure and enabled tools may generate technical information automatically. Public property records and other lawful public sources may also supply information relevant to evaluating a project.

If you provide another person’s information, provide it only when you have authority or another lawful basis to do so.

3. How We Use Information

We use relevant information to:

·       Respond to questions, consultation requests, and project inquiries.

·       Evaluate scope, site requirements, scheduling, budget alignment, and available capacity.

·       Prepare estimates, proposals, agreements, and project records.

·       Coordinate personnel, subcontractors, suppliers, design professionals, inspections, and authorized project activities.

·       Administer billing, payments, customer communications, and ongoing service obligations.

·       Operate, maintain, troubleshoot, and protect our website and business systems.

·       Detect fraud, prevent misuse, resolve disputes, and protect legal rights.

·       Maintain required business records and comply with legal obligations.

·       Provide marketing communications where permitted and subject to applicable choices and consent requirements.

We will obtain additional consent or provide additional notice where required for a materially different use. Public use of identifying project photographs or testimonials is addressed in Section 7.

4. When We Share Information

We disclose information where reasonably necessary for the purposes described in this Policy, including to the following categories of recipients:

Service providers. Website hosting, email, communications, document storage, project-management, accounting, payment, and technical-support providers may process contact, project, transaction, or technical information needed to perform their services. Their access should be limited to their authorized functions and applicable legal or contractual requirements.

Project participants. Relevant contact details, property information, plans, selections, and scheduling information may be shared with subcontractors, suppliers, architects, engineers, inspectors, permitting authorities, and other authorized participants to evaluate or perform requested work.

Professional advisers. Accountants, attorneys, insurers, and other advisers may receive records needed for their professional responsibilities.

Legal and protective purposes. We may disclose relevant information to comply with law, respond to lawful legal process, investigate suspected fraud or security incidents, address disputes, or protect people, property, and legal rights.

Business transactions. Information may be disclosed in connection with a merger, restructuring, financing, or transfer of business assets, subject to applicable confidentiality and legal requirements.

At your direction. We may share information when you request or authorize a disclosure or otherwise provide legally valid consent.

These disclosures do not give project participants permission to use your information for unrelated purposes. Advertising-related disclosures, if any, require the additional considerations in Section 6.

5. Cookies and Similar Technologies

Website functionality may involve cookies, local storage, server logs, or similar technologies. Depending on the features enabled, these technologies may support security, session management, saved preferences, performance measurement, embedded content, or advertising.

The specific technologies in use depend on the website’s current configuration. Where required, the website will provide technology-specific disclosures and a consent or preference mechanism before optional technologies are activated.

You can use browser settings to manage or delete cookies. Blocking certain technologies may affect website functions. Browser settings may not control every form of tracking or information collected by a third-party service.

An embedded map, video, social-media feature, or other third-party resource may collect technical information when loaded or used. Review the relevant provider’s privacy notice and any controls offered on the website.

6. Advertising and Privacy Choices

A disclosure to a service provider for an authorized business function is different from certain advertising-related disclosures, which may qualify as a “sale,” “sharing,” or targeted advertising under applicable law even when no money changes hands.

If VCG uses technologies or arrangements that constitute a sale, sharing, or targeted advertising under applicable law, VCG will provide the required description of those practices and a way to exercise applicable opt-out rights. You may also send an opt-out request to admin@vigilantconstruction.group, identifying the activity you wish to restrict.

Where legally required, VCG will honor recognized browser-based opt-out preference signals, such as Global Privacy Control, for covered processing. A general browser “Do Not Track” setting may not provide the same function as a legally recognized opt-out signal.

You may ask us to stop sending promotional emails by using an available unsubscribe option or contacting us. Service, billing, legal, and project-related communications may continue where appropriate.

7. Project Documents and Confidentiality

Plans, photographs, property details, access instructions, proposals, and other project materials may contain confidential or security-sensitive information. We use these materials for authorized business and project purposes and limit disclosure according to the circumstances, applicable agreements, and law.

Submitting materials does not transfer ownership to VCG or automatically authorize their use in public advertising. We will obtain appropriate permission before publishing identifying client information, private project details, testimonials, or project photographs where permission is required. Permission may be documented separately or in an applicable project agreement.

Ordinary forms and email should not be treated as a secure repository for highly sensitive records. Contact us before submitting restricted documents, access codes, or detailed security information. A separately signed nondisclosure agreement controls information covered by that agreement.

8. Information Security

We use reasonable administrative, technical, and physical safeguards appropriate to the information and business activity involved. Access should be limited to people and service providers with an authorized business need.

No website, email system, transmission method, or storage system can guarantee complete security. If you believe information sent to VCG has been compromised, contact us promptly using the details in Section 15. We will address any legally required incident notifications in accordance with applicable law.

9. Information Retention

We retain information for as long as reasonably necessary for the purposes described in this Policy, subject to legal, contractual, insurance, tax, accounting, warranty, dispute-resolution, and recordkeeping requirements.

Retention periods vary by record type, project status, applicable limitation periods, and whether a legal hold or other preservation duty applies. A request to delete information may be subject to those requirements and lawful exceptions.

When information is no longer needed, it should be deleted, securely disposed of, or deidentified as appropriate. Backup copies may remain until removed through the applicable retention cycle, subject to continuing safeguards.

10. Privacy Requests and State Rights

You may contact us to ask about information associated with you, request corrections, request deletion, or ask us to limit particular uses. Statutory rights depend on your location, the information involved, the nature of the relationship, and whether the relevant law applies to VCG.

Where applicable law provides these rights, you may request:

·       Confirmation of whether personal information is being processed and access to that information.

·       Correction of inaccurate personal information.

·       Deletion of personal information, subject to lawful exceptions.

·       A portable copy of personal information where required and technically feasible.

·       Opt-out of covered sales, sharing, targeted advertising, or qualifying profiling.

·       Consent choices for sensitive personal information where required.

·       Appeal of a decision denying a covered privacy request.

How to submit a request. Email admin@vigilantconstruction.group with the subject Privacy Request, call 270-997-3012, or write to the address in Section 15. Describe the request and provide enough information for us to locate the relevant records. Do not include sensitive identity documents unless we request them through an appropriate method.

Verification and authorized agents. We may take reasonable steps to verify your identity and authority before disclosing, changing, or deleting information. An authorized agent may submit a request where permitted by law, subject to appropriate verification of authorization.

Kentucky residents. Where the Kentucky Consumer Data Protection Act applies to VCG and your information, we will respond without undue delay and within 45 days. An additional 45 days may be used when reasonably necessary, with timely notice explaining the extension. Covered requests are generally free up to twice annually, subject to lawful exceptions.

Appeals. If we deny a covered request, you may appeal by contacting the same email or mailing address and identifying your message as a Privacy Appeal. For appeals covered by Kentucky law, we will provide a written response within 60 days explaining our decision. If an appeal is denied, you may submit a complaint to the Kentucky Attorney General’s Office of Data Privacy.

We will not unlawfully discriminate against you for exercising a protected privacy right. We may retain information or decline part of a request where law permits or requires it, and will explain applicable reasons as required. These provisions do not represent that every state privacy statute applies to every VCG interaction.

11. Electronic Communications

When you contact VCG, we may use the contact information you provide to respond and communicate about your inquiry, estimate, project, account, or privacy request.

Submitting a project inquiry does not, by itself, constitute consent to unrelated automated marketing calls or promotional text messages. Any such communications must satisfy applicable notice, consent, and opt-out requirements. If promotional text messaging is offered, follow the instructions provided with that program to withdraw consent.

12. Children and Minors

Our website and construction inquiry process are intended for adults and are not directed to children under 13. We do not knowingly collect personal information online from children under 13 without any consent required by law.

If you believe a child has provided personal information to VCG, contact us. We will take appropriate steps to review and address the information in accordance with applicable law. Adults submitting photographs or other records involving minors should first ensure they have the necessary authority and permissions.

13. Third Party Services and International Access

Links to third-party websites and platforms are provided for convenience. Independent providers control their own privacy practices, and this Policy does not govern their collection or use of information when you interact with them directly.

VCG operates from Kentucky, United States. Information may be processed in the United States and other locations used by authorized service providers, subject to applicable legal requirements. Accessing the website from another country does not waive your nonwaivable rights or replace any legally required transfer safeguard or consent.

14. Changes to This Policy

We may update this Policy to reflect changes in website features, business practices, service providers, or legal requirements. The date above identifies the latest revision.

Material changes will receive additional notice or consent where required by law. Posting an update does not retroactively authorize a materially different use of previously collected information where additional permission is required.
